Small Construction Site Stormwater Program
On March 10, 2003 the Small Construction Site Stormwater Program from EPA went into effect. Any construction activity that will disturb 1 to 5 acres of soil surface begun after that date must get a Stormwater Permit and have and implement a Stormwater Control and Pollution Prevention Plan. Agricultural and forest activities such as harvesting and planting are exempted from this rule.
The rule requires that landowners, contractors, or agents obtain the permit prior to disturbing the soil. The plan must show the measures that will be taken to minimize erosion on the site and to prevent pollution from other sources leaving the site. A menu of Best Management Practices (BMPs) that can be used to develop the plan are available as is guidance on how to develop the plan and obtain a permit.
This program affects all small construction sites statewide. Parishes and towns that are included in the Stormwater Phase II program have construction and post construction stormwater control objectives in their Stormwater Management Plans and may have specific requirements. Check with your local permitting agency before beginning a construction project or if you have a project begun after March 10, 2003.
